Incomplete Order

Hi,

We have purchased a garden furniture from BHS, and one of the reasons why as it came with a external cover.

However it has not come with the cover and the store have been saying you dont need it - as it garden furnture.

We also purchased this via there 0% interest free option.

My gutt feeling is that they are breach of contract as they have not delivered the goods recieved. The store has no interest in resolving this whats so ever.

Do I contact BHS or the finance company.

Are they in breach of contract under the sales of goods act.

Well yer they are in breach of contact, if you have paid for a product and not got it all its within your rights to demand it be delivered or you have a full refund.

One thing you will need to double check if its a free cover that's they don't say its subject to availability or something as this would then be ok for them not to send it to you, but as long as its part of the product and not a free extra which they clearly state may not be included if out of stock then they are defo in breach.

Tell them if its not sent out to you or they do not give a suitable replacement or what ever it is you want, you will be in contact with their head office in "....." and trading standards as they should be able to give more sound advice on exactly what you can do about this.
