Withtholding Payment for Building Works

Our builder has just presented us with a final bill for extension works (final 25% of total cost). However, we are in dispute with our neighbour who has pointed out that a Party Wall Award was never applied for and roofers may have damaged her flat roof. We have complied with her demands and we have agreed to pay for an independent survey of her property (our builder refused to pay for the survey costs). If the survey finds that damage has been caused to her property, then she will no doubt expect us to put it right. Since this damage would have been caused by our builder, can we withthold all or part of the final payment. Can anyone point us to a law which clarifies this situation?
