Problems with second hand car bought yesterday

Hope someone can help... We collected a second hand car from a dealer yesterday after putting down a deposit on Friday. We test drove the car last week & all was well. We considered the age/mileage of the car and decided to go ahead with the sale providing the dealer would fit a new cam belt prior to purchase. This was agreed and we paid the remaining balance and collected yesterday. Almost straight away we noticed the engine is now very noisy and the exhaust is blowing thick smoke. Neither of these issues were present during the test drive.

When we test drove, the seller said that the car has 3 month warranty that covers 'engine & gearbox failure'. When collecting yesterday we were informed the warranty is only up to the value of £200, with a £50 excess - so virtually useless in the event of a major problem.

The car has gone back to the dealer today (who seems to have changed into an antagonistic and defensive man now we have handed over our money) and is getting it looked at tomorrow to find the source of the problem. We suspect something was done or not done correctly during the cam belt fitting. Until that's done we don't know what's going to happen.

So basically the condition of the car now is not the condition we test drove or put the deposit on and I need to know if we have any comeback. I just don't know what we can or should do now so any help or advice would be greatly appreciated.

Hi, he has an obligation to put the problem right, regardless of warranty. Wait and see what he comes back with, don't go in all guns blazing, but if he starts telling you it's not covered under warranty, inform him that the car wasn't right when you collected it, and you expect him to remedy the problem.If it goes down this route, you will probably have a little bit of a fight on your hands. But, under the Sale Of Goods Act, the car must be fit for purpose, and of merchantable quality, so the law's on your side!
