Warranty with Treadmill

Bought a brand new treadmill last August (2010) from a 100% feedback ebay seller.
The advert claimed to give a 1 year warranty, well it broke down this month and the seller will not respond to my emails, (he is still selling lots and lots of fitness gear including treadmills).
The treadmill was brand new when i bought it (so he claimed), so i decided to contact the manufacture (York), they asked me for the serial number on the treadmill, and yep u guessed right, there was no serial number on the treadmill, so York then refused to repair this treadmill under the warranty and told me to contact the seller ( still no replies from him).
Any ideas as to where i stand ( no pun as my treadmill is broke).

One thing that York fitness told me is that "all their treadmills they make are sold only at Argos and if this treadmill was a return to Argos (returned as faulty to Argos) and then sold onto the Ebay seller then there would not be a warranty".
