reclaiming excess from insurer

in april 2009 my car was parked outside my house when
an uninsured driver whilst in a police chase crashed into my car and wrote it off:mad:
since that point i have been fighting to get my ncb back and my excess...
in feb 2011 i managed to have my no claims reinstated but not my excess £400.
he was taken to court and found liable and ordered to pay.
he offered to pay at ten pound a month...
my insurance company (liverpool victoria)have told me it will cost more for them to collect than they are going to get from him....so have written it off.GOOD NEWS FOR HIM ...
BUT WHERE DO I STAND IN THIS SITUATION? AS THEY TOLD ME I HAVE NO WAY OF GETTING MY EXCESS BACK....i dont want to sound like a whinger...but that is my money and not theirs.....
WHAT ELSE CAN I DO TO RESOLVE THIS SITUATION?

I have been like this twice and the only way if the other party doesn't volunteer to pay your excess is to pursue it via your policy legal cover - if you have that then your insurers should chase it through the courts !
