My son purchased a new ps3 last Monday, paid £199 as it was part of a promotion with free game. When he arrived home from uni on Fri night he attached it up only to discover someone elses profile was already logged on, it was activated on 23 march 2011, at least 40 per cent of the mem was used up. 2 pieces were also missing. The entire console was wrapped and the seal was on box. I rang game who said to bring it in and they would check it out. I feel this is unacceptable. What are my rights in this case. I have receipt showing it was sold as new ps3

Your rights here allow you to return the goods to Game for a full refund / exchange for a brand new Playstation 3 .
Regards to any form of compensation - you may be able to blag your way to a gift card for Game (claiming that you have had to spend money that you wouldnt have usually to return it to the store?) an idea anyway...
