Insurance Dispute

Hi guys, i had an accident on in mid December 2008 and it still has not been sorted, my insurance has settled on a 50/50 "without prejudice" im not happy about this because it was not my fault.
could anyone give me advice on what to do as in a nutshel i was smashed into while i was about to exit an island. the island was clearly marked into lanes and the person who hit me was wanting to take the third exit but was in the outside lane (i was hit on the 2nd exit). she was clearly in the wrong lane and i can proove this.
anyway her lawyers issued court action against me (i was happy about this because i was confident i could win) however my insurance then settled 50/50 and court action was withdrew which i am gutted about. i feel that they called my insurances bluff and won... i would like to know if there is anything i can do, i keep having restless nights thinking of this. does anyone know what i can do, could i take the other party to court, if i win could i then take my insurance to court, im willing to bet im not the only person this has happened to... ANY advice would be appreciated. thanks. Rob

I am not sure what the question is and as the matter has been resolved what have you got to worry about. I would put it behind you and move on.

the question is can i take her to court and have a judge to find her at fault then i can have it overturned... i have lost my 7 years no claims for something thats not my fault. im gutted and i feel like there is nothing i can do about it....

I think you'd be better off on a motoring law forum Coldslogun - this is a very specialised area you're discussing.

You might say "she was definitely in the wrong lane" and that you can prove this, but it is likely that the legal team at your insurers know from experience that fault can be harder to prove than you think.

I'm in a very similar situation, I was parked in a car park, had just stopped, and still had my seat belt on, when a car towing a caravan smashed in the the passenger side and damaged the rear light, rear wing, rear door and front door and the housing of the wing mirror.

This was in June 2009, my insurnce is due for renewal in one week, I have been pestering my insurance company to reflect in my renewal quote that I was not at fault, instead they have added the £1,400 worth of damage to my renewal quote, and have wiped out three years no claims bonus ... and all because the other insurers have yet to respond to my allegations.

I have this week instructed my solicitor to write to the third party and his insurers to speed the process up ... I cannot afford insurance with £1,400 added to my premium, so I have to take action.

I hope you get yours sorted.

do you know of any law forums i can go on to ask about my problem... im really annoyed because the person who hit me had only been driving 2 weeks to top it all off... i certainly want to fight this as far as i can.

i think the way insurance in sorted in this country is completely wrong, it punishes the customer, i thought your insurance company was supposed to help you whan you were in trouble... its desgusting.
