Lost share certificates

Hi,

The company which holds my shares certificates, claims to have posted them to me, but they haven't arrived. They say that to replace them it will cost me £30. I said that the cost shouldn't be borne by me as they posted them and they did not do it by recorded delivery. Their counter claim is that, as soon as they have been posted, the certificates are no longer their responsibility.

The cost doesn't bother me too much (though there is a fair amount of hassel involved), but can they be free of responsibility in this respect? Surely they have a duty to ensure that the certificates reach their final destination, thereafter if I loose them, then it's my fault.

I feel it is outrageous I am charged for something that is in no way my fault and quite frankly, beyond my control. Also should the above be part of their terms and conditions, do I still have any statutory rights in this repsect.

Yours thoughts are welcome.
Cheers
Jules
