hi all,
i bought and paid for a specific delivery on a television for the 10/12/09
between 8am and 6pm. the item never showed up ,so i rung the service
desk that night, had loads of apologies and sorrys and rebooked item for
next day 11/12/09 again between 8am and 6 pm. again no item delivered
and as on both occasions no communication from them, i had to contact
them that night, was not pleased with thier excuses, and cancelled the
order. had a full repayment including delivery charge a week later.
i than wrote to this company asking for payment of 2 days wages at a
cost of 185 pounds a day and 2 return train journeys to my parerents home
which was the delivery address, as they are infirm and housebound, and
could not take delivery, a round trip of 110 miles return journey done twice.

the retailer rung me to say that they will pay back travel costs and might
pay one days wages if i can prove what i earn. i did this with a letter
from my company. had a call from the retailer today and they are prepared
to pay full travel costs at 42.50 pounds, but only 75 pounds wages, which
is less than half a days wages. i have asked them to send this in writing,
but i have not accepted this or declined the offer.

now the big question is do i consider my self lucky that i have had a offer
of compensation , or have i any rights to insist on more money. as i dont
agree with only half a days wages, they caused me to have a 2nd day off
and the item still did not arrive.
in fact i had to lose a 3rd days wages to recieve a delivery off another
retailer who did show up . also their comment that i would of had to take
the first day off to recieve television anyhow. yes!!! if it had turned up/

thanks in advance for any help in this matter
regards james

You want to push them as far as you can without having to go to the Small Claims Court. The judges look dimly on situations where a reasonable offer has been made and refused. Write back and say you will be happy to accept £150 plus travel costs in full and final settlement. I just made that figure up, but it has to be less than the full amount and more than what they have offered. Remember filling in the paperwork for a Small Claim will take you a day probably too.
