Help! Goods paid for but not recieved

We purchased a kitchen from homebase in august 09 on buy now pay in 6months credit. All goods were received apart from fridge/freezer. At the time of order we were told for some reason the fridge/freezer didnt show up on our order but dont worry a seperate order was placed. Now Homebase are saying that they cannot get this particular fridge and that they will give us cash back as we pay the credit balance off in 10 days time. The trouble is they are only offering us £230 when it was £400. They say this is because they knocked so much money off the total order (£178) back in august, but this was the deal he did to get us to buy at that time from them. Can they do this or are we in our rights to demand the total cost of item back?

If the item is listed as £400 in your paperwork and there is no separate line item called discount then probably not. They are in breach of contract. Tell them you will only accept £400 as reasonable damages as this is the list price of the item. If they are not happy with this tell them you are prepared to let a judge decide what is reasonable. How much would the same unit cost somewhere else?

Well the trouble is we never got a copy of the fridge/freezer order. All we have is the original quote which has the total costings for the kitchen then a price that is handwritten saying cost with appliances before the discount. There is nothing on our paperwork showing the discount either. All receipts we have are just for the goods that were delivered.

Hubby has a meeting with the manager and the guy who designed kitchen today will let ya know how it goes fingers crossed, same fridge is £470 elsewhere.
