Refuirbished lap top battery not under warranty?

:confused:Hi I bought a Refurbished laptop from Prtable Universe in January this year, and the supplied onboard battery (Dell C1295) wont charge and consequently cant use laptop unless plugged in, not very portable.
I e-mailed portable universe and asked for details to return battery and get a replacement and this was their reply :

'Batteries are classed as consumable items and have a different warranty to the rest of your laptop. If you have purchased a refurbished laptop then we do not offer any warranty on the battery life, batteries are tested and known to be working at the time of dispatch. If you purchase a new laptop then you are covered by a standard 3 month warranty.

I was under the impression that regardless of it being refurb or new it has to be fit for purpose and if the battery doesnt work then its not a portable computer and not fit for purpose, or do batteries somehow escape the sale of goods act.

Any advice would be welcome before I send any further e-mails.
