Tesco poor service

I bought a Nintendo 3ds for my son's Xmas- he used it for about a month & then all of a sudden, he opened it 1 day & discovered a black splodge like mark & line across the top screen. We took back to Tesco who rang Nintendo, described problem & they said it was caused by impact therefore we must have misused the system. We were told no refund or exchange- could send to Nintendo but at a charge of 78. We are disgusted as we know item has NEVER been misused & quite frankly is not fit for purpose or durable when breaks after 1month of use according to manufacturer instructions. Under SOGA surely we are entitled to a refund but Tesco messing us about & denying us our statutory rights- despite being loyal & we thought valued customers? I now have a distraught 8year old without their xmas present.Any feedback be appreciated.
