Default rights when buying from idividuals

Do you have rights when buying from a private seller on ebay if the item is not as described i.e works perfectly and does not when receive?

Yes.
The SOGA still applies (limited) when purchasing Second hand, and Descriptipn is covered.
If an item is not as described, it is in breach of the Sale of Goods Act.
