Default Faulty clothing, but.....

Hi,

I purhased a new top via the internet. When it arrived all seemed fine, after wearing it for a day I managed to get an ink stain on it. Then when I went to wash it I noticed a hole in the pocket where the stitching hasn't caught the pocket faces. I'd say it's pretty clear to anyone that its a manufacturing error

Will the ink stain affect my rights for a replacement/ refund?

Any advice would be appreciated. Thanks.
