Engagement ring

I've had my engagement ring for 2 years and over the last 12 months it gradually started showing black marks on the inside of the ring. I went to my local Jewellers who looke at it through a loupe and they said the ring was porous and the black marks were pits were it had oxidised, they said it was a manufacturers fault as the imperfection was in the metal.
I sent the ring back to the manufacturer and they are claiming it's not a manufacturing fault but wear and tear and that the ring must of come in contact with something harder.
I refute this as the marks on the inside of the ring whcih has only ever come in contact with my finger.
My local jeweller said the ring has thinned and the porosity will continue an the shank will need replacing in 2 years. (the ring is palladium which should last more than 4 years)

Where do I stand with this?
