Refund or Replace under warranty?

I got a reasonably expensive bluetooth headset from Amazon market place 2 1/2 months ago and one side already stopped working. I contacted Amazon and was told the seller will only give a refund, not a replacement. The price has gone up a lot since I bought it, so I'd be losing money if I accept the refund, as I really need to get a new one.
According to the consumer law can a buyer choose to a have replacement instead of a refund?
I guess the reason they don't want to replace it is due to the new price
