Sold car now he wants refund, help!

Hi,

I sold a car (2001 saab 9-3 SE 2.2td) via ebay in april, it sold for 990. the winning bidder had not been to look at the car prior to bidding, when he came to pick the car up he didn't even have a look round it to see if it was as described and I offered him a test drive first which he refused, he just gave me the cash, signed the 'sold as seen' receipt and drove away.

a week later I received a letter saying that he had taken the car to his local Saab specialist which had deemed the car unroadworthy and gave me a list of all the things wrong with it, some which were really minor (loose exhaust shield etc) but some were major, a broken steering rack and broken bulk head, holes in the footwells, gearbox was loose, the list goes on! Now I find this very hard to believe, I'm no mechanic but the car drove absolutely fine and I did some long trips in it and had my two kids in it which is not something i would do if I thought it was unsafe!

I had only had the car about 2 months as since buying it I got offered another job at a friends firm which is less than a mile from my house therefore no longer needed a diesel. It had been MOT'd by the previous owner just before i bought it and it passed with NO ADVISORIES!

He sent another letter saying he believes I'm a trade seller (don't know why!) and he is going to have me looked into by the inland revenue! I sent one back saying i wouldnt be giving him a refund as he had the chance to have it aa or rac inspected before buying it or to bring whoever he wanted really to check it out, i didn't feel the need to do this as it had recently passed an mot with no advisories! He has now taken it to his local court who have sent me a pack stating his claim and he's saying I now owe him £1200!

It's really stressing me out as i don't have the money and feel like I'm being made out to be a rip off merchant when really I've sold a diesel car with 10months mot and 6 months tax as honestly as I could. surely if these things are really wrong with it they would of been picked up on the mot?? because they don't sound like things that occur overnight. And if they are wrong with it then isn't it the garage that mot'd it that should be taking the blame with it only being done 2 months previous??
