Fault with 2010 Ford car - still making payments

Hope someone can point me in the right direction.

My husbands 2010 car which he purchased from new has recently started leaking in and the passenger footwell is getting soaked. We took it back to the garage where we brought it and they were supposed to have fixed it but we had to pay as "the seals of the car are not under warranty". After a heavy bout of rain on Saturday the car again has leaked in at exactly the same place. We have contacted the garage and they are going to take it in again next Monday. Surely all parts of a car should be under warranty for the first 3 years? Why would anyone purchase a car that leaked?!

We are still paying for the car on finance and have a year to go before a final payment is due. If this leak keeps ongoing (and I have read reports that it seems to as there was a fault with 2010 cars around this time) where do we stand regarding this and payments for "fixing it". Can we take the car back to the garage and tell them we don't want it?
