Leaky Roof

We've recently had a glass roof put over the courtyard at the back of our house plus a bit of building work to turn it into a conservatory. Our builder couldn't give us a fixed price so we've been working on quotes for labour and materials for each section of the works. This has worked well for us all and we have paid every invoice within 2 days of receipt. However, after paying the invoice for the new roof it started to leak. Our builder spent 3 days trying to repair it at no extra cost to us but has now admitted defeat and as he can't fix it. We got a specialist roofer in to look at it and basically he is going to have to undo a fair chunk of work the builder did and start from scratch to rectify it. We have one invoice from him outstanding for works to the utility room and I am reluctant to pay it as he is refusing to accept responsibility for the costs to rectify his shoddy workmanship. I understand that we will have to pay it as it is for a separate element of work which has been completed satisfactorily but I want to delay paying for as long as possible.

Surely we're not being unreasonable in asking him to pay at least a proportion of the additional costs since it was his poor workmanship which caused it and as far as I'm concerned what he's done is not fit for purpose as a new roof shouldn't leak.

Does anybody have any advice on how to get him to pay for the remedial works? We have been in contact by e-mail explaining our position but he is adamant that he is not liable to pay for the works and that he wants his outstanding invoice for the utility room paid. We are considering going to the small claims court but this would have to be a last resort as we need a quick resolution to this before the bad weather sets in.
