In March 2008 I purchased a H I P from Bairstow Eves whilst putting up my flat for sale. I received it. The flat didn't sell.
What I have now discovered is that though Bairstow Eves acknowledge that I did hand over my credit card details, they are now claiming they have no records of having actually processed the payment.
So now 15 months later they have been badgering me to prove that I paid by asking me to check all my statements.
I am not sure which card I used and am extremely annoyed that they are putting the onus on me to prove payment after all this time.
I was telephoned by a debt collection agency today and they say it will potentially go to court.
What are my rights in this case?

Most companies would be too embarassed to collect a small debt after this period of time - HIPS are about £300. I think you need to call Consumer Direct as it all depends upon circumstance and I am pretty sure your obligation to pay still stands. However, you could be unemployed now whereas before you were in employment etc etc
