Returns under the hygiene rules and What qualifies?

I am unclear of what rights still stand when a retailer states hygeien reasons. I am looking to puchase a pair of expensive over the ear headphones and wanted to try them on but the retailer said due to hygiene reasons I could not and that I would not be able to return them. Where do I stand if the item is not comfortable to wear and can they class over the ear headphones under these restrictions?

Lots of shops have headphones on display for you to try e.g. the Apple store. Plus all the music points in HMV etc. Who was the retailer?

If you buy them online you are protected by the Distance Selling Regulations and could try them carefully and return them if they were not to your liking. They would have to be in a saleable condition obviously.
