hi
i purchased a samsung camara from littlewoods catalogue in september 2011, on 27th may 2012 i took some pictures out doors on a sunny day, when i got home the camara would not turn on , sent it off to samsung they say there is water damage and its not covered by warrenty im so annoyed, water has not been spilt on the camara, they say it may have come from a small drop of rain or condensation? and it should not be used out doors,£100 down the drain i dont know what to do next. water damage seems to be a common answer for most products these days looking at different forums.

Re: Phone failure under contract refuse to fix

Firstly, it should be the supplier dealing with this, not the manufacturer so you should be returning it to Littlewoods for repair/replacement/refund.

Fit for purpose springs to mind, why would you buy a camera that could only be used indoors?

Send it back to Littlewoods and tell them they need to take action to repair or replace the camera.

Under SOGA 1979 goods must be

'as described',
'of satisfactory quality', and
'fit for purpose' – this means both their everyday purpose, and also any specific purpose that you agreed with the seller

Because the camera was purchased over six months ago it is for you to prove the camera was faulty even now it has only come to light.

You may have to get a camera specialist to give you something in writing if Littelwoods insist on this. You can claim any cost back from them.

It would be up to Littlewoods if they wanted to refund or replace the camera. If they refund it will be minus the use yo have had out of it since you bought it (recision).

You have to stick at it and not be fobbed off. Write to them quoting SOGA.

As Witch consumer states, it is not reasonable for a camera to be used indoors only unless it stated as much on the sales literature.
