Is leaking roof covered

Please can you help

Bought a secondhand renault clio, 5 door sunroof, got in car today and only discovered a leak, through getting a wet drivers seat. Leak coming from roof, rang dealer as I have a 3 month warranty, but he texted a reply saying this is not covered in warranty. Do I have any grounds to contact trading standards?:

As it is from a dealer, yes you are covered under the Sale of Goods Act, Section 14 'satisfactory quality'.
It's a good job you got it from a dealer, if it was from a private individual it would be a case of 'tough'.

Remember - warranties are in addition to your statutory rights.

Please can I have more advice

I have left out the dealers name just need your advice. I paid £1700 for the car 03 plate. I have just received this email from dealer, what do you think?

"I write in answer to your letter which I received recently with regard to water leak on your vehicle, as previously discussed water leaks are not covered under your warranty and as you have experienced mechanical failure is, as the vehicle is over nine years old it is not unreasonable for you to undertake repairs regardless of how long you have owned the car for, in this case however I am prepared to assist you with the problem and meet you halfway with the repair local specialist,will carry out the repair, the cost will be £125 split 50/50 a cost to you of £62.50, with regard to stating Sale of Goods act 1979 I feel that as a Dealer I am acting in a very fair manner as you have purcased as USED Car not Brand new and the vehicle is of satisfactory quality."

I think that's rather steep for a 9 year old Clio!!!!

Given the rain we have had recently, I'm surprised the leak didn't show up sooner, although you don't actually say how long you have owned the car, does it look like the leak has been 'patched up' prior to the sale? if so it would indicate the dealer knew about the problem before you were sold the car.

Having said that, he is correct that the leak wouldn't be covered by the warranty and I think he's being reasonable offering to meet half the cost on a car of that age.

Just my opinion tho!

Why not just claim under SOGA, satisfactory? As can be seen, it's an argument of what satisfactory quality consists of. But it's only a minor thing I suppose and doesn't affect the drive-ability of the car...

Wow congratulations on your promotion, well deserved sir.

It all depends on what could reasonably be expected for a car of that age and the price paid, again, it's what is reasonable?

The age old personal feeling debate due to the non-defining acts, probably merely to induce arguments between trader and consumer lol <- very political for me.
