Dell Laptop

Hi

I got a laptop free with my phone contract last year. The laptop ran out of warranty in 01/2009 but two months ofter that it stopped working. I have been on the internet and it seems a common problem that the motherboards die. I personally think that a laptop that is only used at weekends should last more than 1 yr 2 mths.

Does any one know if I could speak to Dell about repair / Replacement under the Sales of goods act?

If the warranty has expired then you are not covered by Dell as the Sale of Goods Act only applies to the retailer.

For free items where no money has changed hands e.g. gifts and prizes then you are not covered by the Sale of Goods Act either. The question is whether this is the case here. Was it really a free laptop? Was it central to the contract i.e. a term or was it an additional benefit of the contract?

You should still try to make a claim under the Sale of Good Act, but it does mean your rights are probably diminished and you may struggle to get the desired outcome.

I would give Consumer Direct a call and ask them to review your paperwork.
