Faulty Electronics (vape mod) but retailer does not agree

My husband bought a vape mod online. When he tried it out the display showed low battery warning and would not fire up. This happened with several sets of batteries all of which were fully charged and worked in other items. Other people in online groups have said they have experienced similar with this mod and that it is a manufacturing fault. Some people have reported that it occurs sporadically and gets progressively worse until the it stops working altogether.
My husband contacted the seller who said to return it. It has been returned and the seller said he has tried it out and not received any error. He then said he would use it over the weekend and if it still does not fault he will return it to my husband!
Is this acceptable practice?
Firstly we are concerned that this is a recognised error that is sporadic and progressive. What if he returns it and the fault reoccurs and gets worse?
Secondly, what if his use affects the condition?
