Item returned not in warranty

[Not just mum]

Hi my sons nintendo switch lite was broken and out of warranty, we returned it to be repaired. They have looked at it and say that it cant be repaired, so have offered a new one to be purchased, which we have.

I've emailed them asking if the broken one will be returned to us. They said not. I thought it still belonged to us, am I correct in my thinking.
