As mentioned in ‘How long should it last?’, the statutory term of satisfactory quality only applies if you have bought something from a commercial entity – a supplier or retailer who is acting ‘in the course of a business’. In this respect, your rights under Sale of Goods apply even if the item you have bought is second-hand, as long as you buy it from a registered trader or retailer. If you buy something from a private seller, you don’t have the benefit of this protection and must employ ‘buyer beware’. For this reason, take good care when buying a second hand car from a private seller.

Tough…Unless you got some formal agreement with him to cover anything like this then you don’t have a leg to stand on. What you would have to do is prove that he knew the head gasket was going to blow…Then you may have a case…

My partner bought a memory foam mattress from a man who owns a company through recommendation of a friend. the money has been taken for it but we have waited in for the delivery for two days now and it still hasn’t turned up. we have asked for a refund but and made numerous phone calls but he keeps refusing and saying “i will deliver it”. I brought a car beginning of April and it had been M.O.T 31st March, driving it yesterday the front side wheel literally feel off, the strut had completely eroded luckily wasn’t doing any speed just a three point turn, have I any grounds of comeback on the garage that sold if to me .

My friend purchased a TV. Because of hearing difficulties she usually listens using headphones because she needs the volume high. Once taking the TV from the box she found that there was no socket to plug her headphones in . As she lives below other people she worries about disturbing the other residents if she has the volume to high. She took it back to where she purchased it from but they said because she had taken it out of the box she couldn’t exchange it or have a refund. Is this correct? Thank you.
I purchased a second hand boat which was advertised by another holiday home owner on a site we have our caravan. It was advertised as being well maintained and ready to go. We agreed to the asking price and was even told that prior to the hand over the craft would be checked/trial run and a new battery fitted. This was in September 2016 and we actually took possession in October when it was immediately laid up.
Being a boat it is not as easy to road test, so much of what was said had to be taken in good faith. I have since spent circa £1200 on repairs/servicing and have been told that the boat was previously neglected. One of the items required was a new battery which they said would be fitted prior to purchase. New fuel pump, starter motor and many more bits have been needed, and there is still work required.
We launched the boat about 4 or 5 times and on 3 occasions we have needed help to be towed back to the mariner. This is certainly not as advertised or even fit for purpose, points I have made to the seller.
What is my legal position, can I request my money back in return for the boat?
